The rules that apply when you use AlyfByte’s website, services, and mobile applications available on Google Play and other stores.

1. Agreement to terms

These Terms & Conditions (“Terms”) form a binding agreement between you and AlyfByte (“we,” “us”). They govern your access to and use of:

  • Our website at www.alyfbyte.com;
  • Client services we provide under separate proposals/SOWs;
  • Mobile applications published by AlyfByte on Google Play and other platforms (“Apps”).

By accessing the website, downloading/using an App, or engaging our services, you accept these Terms. If you do not agree, do not use our website, Apps, or services.

2. Definitions

  • “You” means the individual or entity using the website, App, or services.
  • “Content” means text, graphics, code, logos, media, and other materials.
  • “Services” means software development, design, consulting, hosting setup, maintenance, and related work we offer.

3. Website use

You may browse the website for lawful purposes. You agree not to:

  • Attempt unauthorized access to systems, forms, or data;
  • Submit spam, malware, or abusive content via contact forms;
  • Scrape or harvest data in a way that harms site performance or violates law;
  • Misrepresent your identity when contacting us.

Website content is for general information. Project timelines, pricing, and deliverables are confirmed only in a written proposal or contract.

4. Client services

If you hire AlyfByte for development or related work:

  • Scope, fees, milestones, and acceptance criteria are defined in a separate agreement, quotation, or statement of work;
  • Those documents prevail over these Terms if there is a conflict regarding a specific project;
  • You must provide timely feedback, assets, and access needed for delivery;
  • Unless otherwise agreed in writing, invoices are payable as stated in the proposal;
  • We may suspend work for non-payment after notice.

5. Mobile applications (including Google Play)

Apps published by AlyfByte are licensed, not sold, to you for personal or internal business use subject to these Terms and the store’s terms (Google Play / Apple).

  • You must comply with Google Play’s Developer / User policies when using Apps obtained from Play;
  • App features may change with updates; some features may require internet access;
  • We may update, pause, or discontinue an App or feature with or without notice, where permitted;
  • In-app purchases and subscriptions (if any) are billed by the platform (e.g., Google Play Billing) under that platform’s rules for refunds and cancellations;
  • You are responsible for your device, connectivity, and store account security.

6. Accounts and credentials

If an App or service requires an account, you must provide accurate information and keep credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use at support@alyfbyte.com.

7. Intellectual property

  • Website branding, design, and AlyfByte Content are owned by AlyfByte or its licensors;
  • You may not copy, modify, redistribute, or reverse engineer our website or Apps except as allowed by law or written license;
  • For client projects, ownership of custom deliverables is as stated in the project agreement (often transferring upon full payment);
  • Third-party libraries, fonts, SDKs, and open-source components remain subject to their own licenses.

8. User content

If you submit content (messages, feedback, reviews, uploads in an App), you grant AlyfByte a non-exclusive, worldwide, royalty-free license to use that content as needed to operate and improve the services, and you confirm you have rights to submit it. You must not submit unlawful, infringing, or harmful content.

9. Prohibited use

You agree not to use the website or Apps to:

  • Violate any law or third-party rights;
  • Distribute malware, phishing, or fraudulent schemes;
  • Interfere with or disrupt servers, networks, or other users;
  • Attempt to bypass security or rate limits;
  • Use automated means to abuse APIs or forms without permission;
  • Engage in hate, harassment, or illegal adult content where prohibited.

10. Payments, trials, and subscriptions

Where an App offers paid features:

  • Prices are shown in the store listing or in-app;
  • Billing, taxes, renewals, and refunds for store purchases are handled by Google Play / Apple according to their policies;
  • For direct client invoices (website/services), payment terms in the proposal apply;
  • Failure to pay may result in suspension of services or premium App features.

11. Disclaimers

THE WEBSITE, APPS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant uninterrupted or error-free operation, or that defects will be corrected immediately.

Educational or informational Apps (if any) do not guarantee exam results, scores, or professional outcomes.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALYFBYTE AND ITS TEAM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE WEBSITE, APPS, OR SERVICES.

Our total liability for any claim relating to the website or a free App is limited to INR 5,000 or the amount you paid us for the specific paid service/App feature in the 3 months before the claim, whichever is greater, except where liability cannot be limited under applicable law.

13. Indemnity

You agree to defend and indemnify AlyfByte against claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the website/Apps, your content, or your violation of these Terms or law.

14. Suspension and termination

We may suspend or terminate access to the website, an App, or an account if you breach these Terms, create risk/harm, or as required by platforms/law. You may stop using the website or uninstall Apps at any time. Provisions that should survive (IP, disclaimers, liability limits, indemnity) will survive termination.

15. Governing law and disputes

These Terms are governed by the laws of India. Courts in Gujarat, India (or as otherwise required by mandatory consumer law) shall have exclusive jurisdiction, subject to any mandatory rights you have in your place of residence.

16. Changes to these Terms

We may update these Terms periodically. The “Last updated” date will be revised. Continued use after changes constitutes acceptance where permitted. For material App changes, we may also note updates in store listings or release notes.
